General terms and conditions of business
I. Registration
- The contract between the Otter swimming school and the course participant becomes legally binding upon receipt of the registration and confirmation from the swimming school. By registering, the course participant, or in the case of minors, their legal guardian, agrees to pay the course fee.
- When you contact us by email or via a contact and booking form, we store the data you provide (email address, and optionally your name and telephone number) in order to answer your inquiries. This data will be deleted as soon as it is no longer needed, or its processing will be restricted if there are legal retention obligations.
- By registering, the course participant confirms that they are in good health. Any potential health risks should be medically assessed beforehand. The swimming school must be informed of any physical limitations in advance. A medical certificate is not required.
- Should a participant be unable to attend the course for an important reason, the swimming school must be informed in writing or by email as soon as possible. Withdrawal is possible up to six weeks before the course begins.
- Failure to attend or early termination of the course does not entitle participants to a refund or non-payment of the course fee.
- In the event of illness of the course participant, the course fee will not be refunded. There is no entitlement to make up missed hours.
- In case of illness of the course participant lasting more than three course hours (with a doctor's certificate) or during spa stays, the hours can be made up in consultation with the swimming school.
- If a swimming lesson is cancelled due to instructor illness, technical problems, or other unforeseen events, it will be rescheduled. If a make-up lesson cannot be offered, the course fee will be refunded proportionally.
- The courses are subject to a minimum number of participants. If this number is not reached, the swimming school will offer an alternative date. There is no legal entitlement to the course taking place.
- Of a lesson, 45 minutes are spent in the water; the rest is used for organization, changing clothes, showering and other preparations and follow-up work.
II. Payment Terms
- The course fee must be paid within 14 days of registration, but no later than before the course begins. Only timely payment entitles you to participate in the course.
- If you cancel up to one week before the course starts, 35% of the course fee will be retained as a processing fee. Substitute participants are accepted.
- If you cancel your registration before the second class, 50% of the course fee will be refunded. After that, no refund is possible.
III. Liability and Insurance Coverage
- The swimming school's insurance coverage only extends to the time spent in lessons.
- The swimming school is liable only in cases of intent and gross negligence. It is liable for damages to life, body, or health even in cases of slight negligence.
- The swimming school accepts no liability for damage caused by the course participant himself or for property damage caused by the participant.
- Accompanying persons and guardians who are present on the premises during course hours do so at their own risk. They are not covered by insurance.
- No liability is accepted for valuables and clothing.
IV. Offers and Prices
- All offers are non-binding. We cannot exclude the possibility of printing errors or other mistakes. The prices valid at the time of contract conclusion apply.
V. Guarantee of Success
- The course content may be adjusted due to new developments or changes, as long as the content required for the qualification is covered. No guarantee of success is given, nor is any liability accepted for failure to achieve the course objective.
VI. Code of Conduct
- The swimming pool's house and bathing rules, as well as the instructions of the pool staff, must be observed. Access to the swimming pool is only permitted in the presence of the course instructor.
- Entry to the pool is permitted 15 minutes before the start of the course with the course instructor, and the pool must be vacated 15 minutes after the end of the course.
- Children aged 8 and over must change independently in the designated changing rooms. Parents and accompanying adults are not permitted in the changing rooms or shower area. Access is only allowed up to the entrance of the swimming pool.
- For children under 8 years old, our trainers will assist with changing clothes in the designated changing rooms and with drying their hair.
- Please bring the following items: bathing shoes, towel, bathrobe, swimwear, shower gel and, if necessary, a hair tie.
- Neoprene clothing is permitted during swimming lessons. However, regular swimwear must be worn for the swimming test.
- Before the course begins, participants should use the toilet and take a shower.
- Participants will be received in the shower area five minutes before the course begins and brought back there after the course.
- The swimming pool must be vacated after the children have been handed over, so as not to disturb other swimming activities.
- The instructor's instructions must be followed.
- In cases of serious violations of the rules of conduct, course participants or their companions may be excluded from the course without entitlement to a refund.
- The course participant is responsible for order and cleanliness in the changing rooms.
VII. Place of performance and jurisdiction
- The place of performance is the swimming pool booked for the respective course, regardless of whether it is an indoor or outdoor pool. Any changes must be made in writing.
VIII. Data Protection
- The registration data is stored in the swimming school's IT system in accordance with the Federal Data Protection Act (BDSG) and is not passed on to third parties, except where legally required.
IX. Severability Clause
- Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable law.
